SCOPE OF APPLICATION. DEFINITIONS

The contract entered into between MAF SRL (REA number NA-825310 and registration number in the Companies' Register 06598791215) with registered office in Via San Filippo 4, 80122 Naples (NA) and the Customer shall be considered concluded with the acceptance, even partial, of the order by MAF SRL. Such acceptance is considered tacit, unless otherwise communicated in any way to the Customer. By placing an order in the various ways provided, the Customer declares to have read all the information provided to him during the purchase procedure and to fully accept the general conditions and payment conditions transcribed below. 

If the Customer is a consumer (i.e. a natural person purchasing the goods for purposes not related to his or her professional activity), once the on-line purchase procedure has been completed, he or she shall print or save an electronic copy and in any case retain these general terms and conditions of sale, in accordance with the provisions of Articles 3 and 4 of Legislative Decree 185/1999 on distance sales.

Any right of the Customer to damages or compensation as well as any contractual or extra-contractual liability for direct or indirect damages to persons and/or property caused by the non-acceptance, even partial, of an order is excluded.

PAYMENT METHODS

In the case of payment by bank transfer in advance (the data will be automatically provided at the time of purchase), what has been ordered by the customer will be kept committed until receipt of proof of the transfer to be sent to MAF SRL by e-mail [email protected] within and no later than three working days from the date of acceptance of the order. The dispatch of what has been ordered shall only take place upon the actual crediting of the amount due to the current account of MAF SRL, which shall take place within seven working days from the date of acceptance of the order. Beyond this deadline, the order shall be deemed automatically cancelled. In the event of a Bank Transfer made on-line, the time will be considerably shortened.

The reason for the Advance Bank Transfer must state: 

  • the order reference number; 
  • the date on which the order was placed; 
  • first and last name of the order holder.

PAYMENT BY CREDIT CARD VIA PAYPAL

Payment will be made by charging the purchase amount directly to the credit card. The customer will fill out a special form created by PayPal for the purchase in which to enter the card number and shipping data. The credit card or prepaid card payment system is guaranteed by the PayPal secure server. At no time during the purchase process is MAF SRL able to know the information relating to the buyer's credit card, which is transmitted via secure connection. No computer archive of MAF SRL will retain such data. Therefore, under no circumstances can MAF SRL be held responsible for any fraudulent and undue use of credit cards by third parties when paying for products on www.gellinna.it/shop.

CASH

In the event of a cash-on-delivery purchase, payment shall be made upon receipt of the goods and must be made in cash or by bank draft payable to the courier if the order exceeds €1,000.00. Payment by cash on delivery shall be subject to a surcharge of €5.00 for collection costs. Notification to the Customer of which courier will be entrusted with the delivery shall be made in the manner provided for on the site. Nothing more than what is indicated at the time the order is placed shall be due from the Customer.

PAYMENT ON COLLECTION AT OUR PREMISES (COLLECT AND PAY)

In this case you can shop online, pick up and pay for the products ordered at our premises in Giugliano in Campania (NA). Thanks to this service, you will not incur any shipping costs. Payments can be made by Cash, Bancomat or Credit Card (only in this case the goods will be delivered if the holder of the Credit Card is the same as the one making the withdrawal, for this reason we will ask you to show an identification document).

RIGHT OF WITHDRAWAL

If the customer is a consumer (i.e. a natural person who purchases the goods for purposes not related to his professional activity, i.e. he does not make the purchase by indicating in the order form to MAF SRL a VAT number), he is entitled to withdraw from the purchase contract for any reason whatsoever, without the need to provide explanations and without any penalty, except as indicated in the following points.

To exercise this right, the customer must send MAF SRL a communication to that effect, within 14 working days from the date of receipt of the goods. This communication must be sent by email to [email protected] or by registered letter with acknowledgement of receipt addressed to:

Once we have received the aforesaid notice of withdrawal, MAF SRL's customer service will promptly provide the customer with instructions on how to return the goods, which must be received by MAF SRL within 10 days of authorisation. 

The goods must be returned undamaged, complete with all parts and in their original packaging (envelopes and wrappings), cared for and, if necessary, used in accordance with normal diligence, without any signs of wear and tear or soiling, in accordance with the conditions of the following points.

The right of withdrawal is however subject to the following conditions:

The right applies to the purchased product in its entirety; it is not possible to exercise withdrawal only on part of the purchased product (e.g.: accessories, attached software, etc.); the right does not apply to sealed audiovisual products or computer software (including hardware attachments) once they have been opened; the purchased goods must be intact and returned in their original packaging.accessories, attached software, etc...); the right does not apply to audiovisual products or sealed computer software (including those attached to hardware) once opened; the purchased goods must be intact and returned in their original packaging, complete in all its parts (including packaging and any documentation and accessories: manuals, cables, etc..); in order to limit damage to the original packaging, we recommend, when possible, to put it in a second box; in all cases, the affixing of labels or adhesive tapes directly on the original product packaging should be avoided; in accordance with the law, the shipping costs relating to the return of the goods shall be borne by the customer; delivery costs to the customer (even if not displayed at the time the order is placed) and any other additional costs highlighted at the time the order is placed shall not be reimbursed; the shipment, until the certificate of receipt in our warehouse, is under the customer's full responsibility; in case of damage to the goods during transport, MAF SRL will notify the customer (within 5 working days of receipt of the goods in their stores) to enable him to file a timely complaint against the carrier of his choice and obtain reimbursement of the value of the property (if insured); in this case, the product will be made available to the customer for its return, at the same time canceling the request for withdrawal; MAF SRL is not responsible in any way for damage or theft/loss of goods returned by uninsured shipments; upon its arrival in the warehouse, the product will be examined to assess any damage or tampering not resulting from transport. If the packaging and / or the original packaging are damaged, MAF SRL will deduct from the refund due to a percentage, but no more than 10% of the same, as a contribution to the costs of restoration.

Without prejudice to any repair costs for ascertained damage to the original packaging, MAF SRL will refund the customer the full amount already paid (excluding shipping costs), within 14 days from the return of the goods, by transferring the amount charged to the Credit Card or by Bank Transfer. In the latter case, it shall be the customer's responsibility to promptly provide the bank details on which to obtain the refund (ABI - CAB - Current Account of the invoice holder).

The right of withdrawal is totally forfeited for lack of the essential integrity of the goods (packaging and/or its contents) in cases where MAF SRL ascertains:

The non-diligent use of the product that has compromised its integrity or the use of any consumable materials; the lack of the external packaging and/or the original internal packaging; the absence of integral elements of the product (accessories, cables, manuals, parts, ...); damage to the product for causes other than its transport.

In the event of forfeiture of the right of withdrawal, the goods shall remain at the premises of MAF SRL at the customer's disposal for collection at his expense.

PRIVACY

The personal data requested when placing an order are collected and processed in order to satisfy the Customer's express requests and will not under any circumstances or for any reason be passed on to third parties. MAF SRL guarantees its customers compliance with the regulations on the processing of personal data, governed by the privacy code under DL 196 of 30.06.03.

PURCHASING METHODS

The Customer may only purchase the products present in the MAF SRL electronic catalogue at the time of placing the order and viewable online at http://www.gellinna.it/shop as described in the relevant information sheets. It is understood that the picture accompanying the descriptive sheet of a product may not be perfectly representative of its characteristics but may differ in colour, size, and accessory products present in the picture. 

The correct receipt of the order is confirmed by MAF SRL by means of an e-mail reply, sent to the e-mail address communicated by the Customer. This confirmation message will contain the Date and Time of execution of the order and a Customer Order Number to be used in any further communication with MAF SRL. The message will repeat all the data entered by the Customer, who undertakes to check that they are correct and to promptly communicate any corrections, according to the procedures described in this document. 

In the event of non-acceptance of the order, MAF SRL guarantees prompt notification to the customer. 

All sales prices of the products on www.gellinna.it/shop are indicated next to each product and include VAT and any other taxes for SHIPPING WITHIN THE EUROPEAN COMMUNITY. Any shipping costs (all orders exceeding €99.00 benefit from free shipping throughout the country) will be displayed automatically during the order process, before the payment procedure begins.

SHIPPING

Delivery is free for purchases over € 500.00. The cost of shipping is indicated on each item.

The delivery time from dispatch is 2-3 working days, for islands and inconvenient locations it takes 1 or 2 days longer.

The Republic of San Marino will have the same shipping cost as in Italy.

We point out that the above delivery times are for indicative purposes only; we do not assume any commitment or guarantee that they will be respected.

Pick up and pay: Pick up at our premises located in Via S. Francesco a Patria, 54 - Giugliano in Campania (NA), with 24 hours notice, saving the cost of shipping.

MODALITY

MAF SRL delivers express shipments the same day the order is placed, if placed before 11:00 a.m. on a working day, if all products are marked 'AVAILABLE' and with the following payment methods: Credit Card and Cash on Delivery.

All orders received after 11 a.m. but with the same availability and payment characteristics will be processed on the next working day.

They are always delivered within a maximum of 14 working days except in special cases.

For orders not available or with future availability dates, customer service will make arrangements directly with the customer.

In the event that articles available for immediate delivery are included in the same order together with articles to be ordered, the customer will receive a single delivery.

Upon arrival of the courier, the customer shall check in its presence that

1) The number of packages delivered corresponds to the number indicated in the transport document.

2) The description on the packages corresponds to what is actually indicated on the transport document.

3) The packaging is intact, perfectly sealed and not otherwise altered.

Any damage to the packaging and/or the product, or the mismatch in the number of packages or descriptions, must be immediately reported to the courier, with the words RESERVE OF CHECK FOR NON-INTEGRATED PACKAGING, wet packaging or missing parts, etc., and the reason for this must be specified on the courier's proof of delivery.

Once the courier's document has been signed, the customer may not object in any way to the external characteristics of what has been delivered.

MAF SRL shall not be held liable for goods received in non-intact packages accepted without the wording RESERVE OF CHECK FOR NON-INTEGRATED PACKAGE.

Any problems with the correspondence, completeness or physical integrity of the products received must be reported within three days of delivery by contacting our service department by e-mail [email protected]; for damaged goods, please necessarily attach photos in digital format to assess the extent of the damage.

In the event of failure to collect the material in stock at the courier's warehouses within five working days due to repeated impossibility of delivery to the address indicated by the customer when placing the order or due to rejection of the goods, the order will be automatically cancelled and you will be charged the return shipping costs of EUR 24.00 for single packages, EUR 72.00 for shipments on pallets, and any accrued storage costs.

COMPLAINTS

Any complaints must be addressed to MAF SRL, Via San Francesco a Patria, 54 - Giugliano in Campania (NA) within 7 days of receipt of the goods.

LEGAL GUARANTEE

All products sold by MAF SRL are covered by the conventional manufacturer's warranty and by the 24-month warranty for conformity defects, pursuant to DL 24/02. To benefit from warranty assistance, the Customer must keep the invoice (or the delivery note).

Exercise of the Warranty may involve requesting assistance from Authorised Service Centres in the territory and/or following the procedures illustrated in the documentation inside the product packaging.

The manufacturer's conventional warranty is provided in the manner illustrated in the documentation inside the product packaging. If, following intervention by an Authorised Assistance Centre, the defect turns out not to be covered by the manufacturer's conventional warranty, the Customer will be charged for any verification and repair costs requested by the Authorised Assistance Centre, as well as transport costs, if incurred by MAF SRL.

The 24-month guarantee pursuant to DL 24/02 applies to products that present a conformity defect, provided that the product itself is used correctly, in compliance with its intended use and with the provisions of the enclosed technical documentation. This warranty is reserved for the private consumer (a natural person who purchases goods for purposes not related to his professional activity, i.e. making a purchase without indicating a VAT number on the order form). In case of lack of conformity, MAF SRL provides, without cost to the Customer, the restoration of conformity of the product by repair/replacement or reduction of the price, until the termination of the contract. If, following intervention by an Authorised Assistance Centre, the defect does not result as a conformity defect in accordance with DL 24/02, the Customer will be charged for any costs of verification and restoration required by the Authorised Assistance Centre, as well as transport costs if incurred by MAF SRL.

Replacements in the event of DOA (Dead On Arrival: product not working on delivery) only take place if expressly provided for by the manufacturer. The timing of replacement or eventual repair of the product depends exclusively on the manufacturer's policies.

In the event that, for any reason, MAF SRL is unable to return a product under warranty (restored or replaced) to its customer, MAF SRL may proceed at its own discretion to refund the amount paid, taking into account the use of the goods, or to replace it with a product of equal or superior characteristics.

The timing of repair or eventual replacement of the product depends solely on the policies of the manufacturer and no damages can be claimed from MAF SRL for any delays in repair or replacement.

In cases where the application of the warranties provides for the return of the product, the goods must be returned by the Customer in their original packaging, complete in all its parts (including packaging and any documentation and accessory equipment: manuals, cables, etc.); to limit damage to the original packaging, we recommend inserting it in a second box; in all cases, the affixing of labels or adhesive tapes directly onto the original product packaging must be avoided.

HOMOLOGATION

The vendor declares that all products in the catalogue and marketed are compliant with the standards and approved according to the regulations of the European Community. The vendor shall not be liable in the event of any deviations from the standards of countries outside the European Community and/or failure to have the products approved by such countries.

APPLICABLE LAW

The sales contract between the Customer and MAF SRL is concluded in Italy and governed by Italian law. For the solution of civil and criminal disputes arising from the conclusion of this distance sales contract, if the Customer is a consumer, the territorial jurisdiction is that of the court of reference of his town of residence; in all other cases, the territorial jurisdiction is exclusively that of the Court of Naples.
